1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
530-9 as follows:
 
6    (105 ILCS 5/30-9)  (from Ch. 122, par. 30-9)
7    Sec. 30-9. General Assembly scholarship; conditions of
8admission; award by competitive examination.
9    (a) In this Section, "relative" means a person related to
10an individual as father, mother, son, daughter, brother,
11sister, uncle, aunt, great aunt, great uncle, first cousin,
12nephew, niece, husband, wife, grandfather, grandmother,
13grandson, granddaughter, father-in-law, mother-in-law,
14son-in-law, daughter-in-law, brother-in-law, sister-in-law,
15stepfather, stepmother, stepson, stepdaughter, stepbrother,
16stepsister, half brother, or half sister and includes the
17father, mother, grandfather, or grandmother of the
18individual's spouse and the individual's fiance or fiancee.
19    (b) Each member of the General Assembly may nominate
20annually 2 persons of school age and otherwise eligible, from
21his district; each shall receive a certificate of scholarship
22in any State supported university designated by the member. Any
23member of the General Assembly in making nominations under this

1Section may designate that his nominee be granted a 4 year
2scholarship or may instead designate 2 or 4 nominees for that
3particular scholarship, each to receive a 2 year or a one year
4scholarship, respectively. A nominee must not be a relative of
5the member making the nomination. The nominee, if a graduate of
6a school accredited by the University to which nominated, shall
7be admitted to the university on the same conditions as to
8educational qualifications as are other graduates of
9accredited schools. If the nominee is not a graduate of a
10school accredited by the university to which nominated, he
11must, before being entitled to the benefits of the scholarship,
12pass an examination given by the superintendent of schools of
13the county where he resides at the time stated in Section 30-7
14for the competitive examination. The president of each
15university shall prescribe the rules governing the examination
16for scholarship to his university.
17    (c) A member of the General Assembly may award the
18scholarship by competitive examination conducted under like
19rules as prescribed in Section 30-7 even though one or more of
20the applicants are graduates of schools accredited by the
21university.
22    (d) A member of the General Assembly may delegate to the
23Illinois Student Assistance Commission the authority to
24nominate persons for General Assembly scholarships which that
25member would otherwise be entitled to award, or may direct the
26Commission to evaluate and make recommendations to the member

1concerning candidates for such scholarships. In the event a
2member delegates his nominating authority or directs the
3Commission to evaluate and make recommendations concerning
4candidates for General Assembly scholarships, the member shall
5inform the Commission in writing of the criteria which he
6wishes the Commission to apply in nominating or recommending
7candidates. Those criteria may include some or all of the
8criteria provided in Section 25 of the Higher Education Student
9Assistance Act. A delegation of authority under this subsection
10(d) paragraph may be revoked at any time by the member.
11    (e) Failure of a member of the General Assembly to make a
12nomination in any year shall not cause that scholarship to
13lapse, but the member may make a nomination for such
14scholarship at any time thereafter before the expiration of his
15term, and the person so nominated shall be entitled to the same
16benefits as holders of other scholarships provided herein. Any
17such scholarship for which a member has made no nomination
18prior to the expiration of the term for which he was elected
19shall lapse upon the expiration of that term.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
