| 1 | AN ACT concerning State government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Department of State Police Law of the
Civil | ||||||
| 5 | Administrative Code of Illinois is amended by adding Section | ||||||
| 6 | 2605-407 as follows: | ||||||
| 7 | (20 ILCS 2605/2605-407 new) | ||||||
| 8 | Sec. 2605-407. Illinois State Police Projects Trust Fund. | ||||||
| 9 | The Illinois State Police Projects Trust Fund is created as a | ||||||
| 10 | trust fund in the State treasury. This Trust Fund is | ||||||
| 11 | established to receive funds awarded to the Department of State | ||||||
| 12 | Police from the following: (i) all federal departments and | ||||||
| 13 | agencies for the specific purposes established by the terms and | ||||||
| 14 | conditions of the federal awards and (ii) pass-through grants | ||||||
| 15 | from State departments and agencies for the specific purposes | ||||||
| 16 | established by the terms and conditions of the grant | ||||||
| 17 | agreements. All interest earned by the investment or deposit of | ||||||
| 18 | moneys accumulated in the Trust Fund shall be deposited into | ||||||
| 19 | the Trust Fund. | ||||||
| 20 | Section 10. The Illinois Emergency Management Agency Act is | ||||||
| 21 | amended by adding Section 17.5 as follows: | ||||||

| 1 | (20 ILCS 3305/17.5 new) | ||||||
| 2 | Sec. 17.5. Homeland Security Emergency Preparedness Fund. | ||||||
| 3 | The Homeland Security Emergency Preparedness Fund is created as | ||||||
| 4 | a special fund in the State treasury. The Fund shall be held | ||||||
| 5 | separate and apart from all public moneys or funds of this | ||||||
| 6 | State. All moneys received by the Agency under Section 17 from | ||||||
| 7 | a federal department or agency shall be deposited into the | ||||||
| 8 | Fund. Interest earned by the investment or deposit of moneys | ||||||
| 9 | accumulated in the Fund shall be deposited into the Fund. The | ||||||
| 10 | Agency is authorized to expend any moneys in the Fund for the | ||||||
| 11 | specific purposes established by the terms and conditions of | ||||||
| 12 | the federal awards received by the Agency and in any amount | ||||||
| 13 | that the Agency deems necessary to make grants and pay expenses | ||||||
| 14 | in connection with its emergency management and preparedness | ||||||
| 15 | programs. | ||||||
| 16 | Section 15. The Illinois Motor Vehicle Theft Prevention Act | ||||||
| 17 | is amended by adding Section 8.5 as follows: | ||||||
| 18 | (20 ILCS 4005/8.5 new) | ||||||
| 19 | Sec. 8.5. State Police Motor Vehicle Theft Prevention Trust | ||||||
| 20 | Fund. The State Police Motor Vehicle Theft Prevention Trust | ||||||
| 21 | Fund is created as a trust fund in the State treasury. The | ||||||
| 22 | State Treasurer shall be the custodian of the Trust Fund. The | ||||||
| 23 | Trust Fund is established to receive funds from the Illinois | ||||||
| 24 | Motor Vehicle Theft Prevention Council. All interest earned | ||||||

| 1 | from the investment or deposit of moneys accumulated in the | ||||||
| 2 | Trust Fund shall be deposited into the Trust Fund. Moneys in | ||||||
| 3 | the Trust Fund shall be used by the Department of State Police | ||||||
| 4 | for motor vehicle theft prevention purposes.

| 5 | Section 20. The State Finance Act is amended by adding | ||||||
| 6 | Section 5.786 as follows: | ||||||
| 7 | (30 ILCS 105/5.786 new) | ||||||
| 8 | Sec. 5.786. The Homeland Security Emergency Preparedness | ||||||
| 9 | Fund. | ||||||
