Amends the Counties Code. In provisions concerning coroner's fees, requires that the coroner waive the fee for a copy of an autopsy report if the copy is requested by a physician who provided the coroner with a copy of the decedent's medical records free of charge. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Counties Code is amended by changing Section |
5 | | 4-7001 as follows:
|
6 | | (55 ILCS 5/4-7001) (from Ch. 34, par. 4-7001)

7 | | Sec. 4-7001. Coroner's fees. The fees of the
coroner's |
8 | | office shall be as follows:
|
9 | | 1. For a copy of a transcript of sworn testimony: $5.00 |
10 | | per page.
|
11 | | 2. For a copy of an autopsy report (if not included in |
12 | | transcript):
$50.00. The coroner must waive this fee if the |
13 | | copy of the autopsy report is requested by a physician who |
14 | | provided the coroner with a copy of the decedent's medical |
15 | | records free of charge.

16 | | 3. For a copy of the verdict of a coroner's jury: |
17 | | $5.00.
|
18 | | 4. For a copy of a toxicology report: $25.00.
|
19 | | 5. For a print of or an electronic file containing a |
20 | | picture obtained by the coroner: actual cost or
$3.00, |
21 | | whichever is greater.
|
22 | | 6. For each copy of miscellaneous reports, including |
23 | | artist's
drawings but not including police reports: actual |

1 | | cost or $25.00,
whichever is greater.
|
2 | | 7. For a coroner's or medical examiner's permit to |
3 | | cremate a dead
human body: $50.00. The coroner may waive, |
4 | | at his or her discretion, the permit fee if the coroner |
5 | | determines that the person is indigent and unable to pay |
6 | | the permit fee or under other special circumstances.

7 | | All of which fees shall be certified by the court; in the |
8 | | case of
inmates of any State charitable or penal institution, |
9 | | the fees shall be
paid by the operating department or |
10 | | commission, out of the State
Treasury. The coroner shall file |
11 | | his or her claim in probate for his or
her fees and he or she |
12 | | shall render assistance to the State's attorney
in the |
13 | | collection of such fees out of the estate of the deceased. In
|
14 | | counties of less than 1,000,000 population, the State's |
15 | | attorney shall
collect such fees out of the estate of the |
16 | | deceased.
|
17 | | Except as otherwise provided in this Section, whenever the |
18 | | coroner is
required by law to perform any of the duties of the |
19 | | office of the
sheriff, the coroner is entitled to the like fees |
20 | | and compensation as
are allowed by law to the sheriff for the |
21 | | performance of similar
services.

22 | | Except as otherwise provided in this Section, whenever the |
23 | | coroner of
any county is required to travel in the performance |
24 | | of his or her
duties, he or she shall receive the same mileage |
25 | | fees as are authorized
for the sheriff of such county.

26 | | All fees under this Section collected by or on behalf of |

1 | | the coroner's
office shall be paid over to the county treasurer |
2 | | and deposited into a special account in the county treasury. |
3 | | Moneys in the special account shall be used solely for the |
4 | | purchase of electronic and forensic identification equipment |
5 | | or other related supplies and the operating expenses of the |
6 | | coroner's office.

8 | | Section 99. Effective date. This Act takes effect upon |
9 | | becoming law.
