AMENDMENT TO HOUSE BILL 1216

2    AMENDMENT NO. ______. Amend House Bill 1216, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The School Code is amended by adding Section
611E-190 as follows:
 
7    (105 ILCS 5/11E-190 new)
8    (Section scheduled to be repealed on January 31, 2013)
9    Sec. 11E-190. School District Realignment and
10Consolidation Commission.
11    (a) The School District Realignment and Consolidation
12Commission is established. The Commission shall consist of the
13following voting members:
14        (1) the Lieutenant Governor or his or her appointee,
15    who shall serve as the Chairperson;
16        (2) one member appointed by the State Board of

1    Education;
2        (3) a member of the General Assembly appointed by the
3    Speaker of the House of Representatives;
4        (4) a member of the General Assembly appointed by the
5    Minority Leader of the House of Representatives;
6        (5) a member of the General Assembly appointed by the
7    President of the Senate;
8        (6) a member of the General Assembly appointed by the
9    Minority Leader of the Senate;
10        (7) a representative of a statewide professional
11    teachers' organization appointed by the head of that
12    organization;
13        (8) a representative of a different statewide
14    professional teachers' organization appointed by the head
15    of that organization;
16        (9) a representative of a statewide organization that
17    represents school boards appointed by the head of that
18    organization;
19        (10) a representative of a statewide organization
20    representing principals appointed by the head of that
21    organization;
22        (11) a representative of an organization representing
23    professional teachers in a city having a population
24    exceeding 500,000 appointed by the head of that
25    organization;
26        (12) a representative of an association representing

1    school business officials appointed by the head of that
2    association;
3        (13) a representative of an association representing
4    school administrators appointed by the head of that
5    association;
6        (14) a representative from an organization
7    representing large unit school districts appointed by the
8    head of that organization;
9        (15) a representative from the Chicago Board of
10    Education appointed by the Chicago Board of Education;
11        (16) a representative from an organization
12    representing administrators of special education appointed
13    by the head of that organization;
14        (17) a representative from a statewide parent
15    organization appointed by the head of that organization;
16    and
17        (18) a representative from an organization
18    representing high school districts appointed by the head of
19    that organization.
20    Members shall serve without compensation, but shall be
21reimbursed for their reasonable and necessary expenses from
22funds appropriated for that purpose. Members shall be
23reimbursed for their travel expenses from appropriations to the
24State Board of Education available for that purpose and subject
25to the rules of the appropriate travel control board.
26    The Commission shall meet at the call of the chairperson,

1with the initial meeting of the Commission being held as soon
2as possible after the effective date of this amendatory Act of
3the 97th General Assembly, and shall hold public hearings
4throughout this State.
5    The State Board of Education shall provide assistance and
6necessary staff support services to the Commission.
7    (b) The purpose of the Commission is to make
8recommendations to the Governor and General Assembly on the
9number of school districts in this State, the optimal amount of
10enrollment for a school district, and where consolidation and
11realignment would be beneficial. The Commission's
12recommendations must focus on all of the following areas:
13        (1) Reducing the money spent on duplication of efforts.
14        (2) Improving the education of students by having less
15    obstacles between qualified teachers and their students.
16        (3) Lowering the property tax burden.
17        (4) Providing recommendations as to what the net cost
18    savings of realignment is to this State.
19        (5) Providing input to school districts on
20    reorganization.
21    (c) On or before July 1, 2012, the Commission must vote on
22its recommendations and file a report with the Governor and the
23General Assembly. If the Commission adopts the report by an
24affirmative vote of at least 11 of its members, then the
25General Assembly must, within 14 days after the report is filed
26by the Commission, vote on whether to accept the report by the

1adoption of a resolution by a record vote of a majority of the
2members elected in each house. If the General Assembly is not
3in session on the day that the report is filed, then the
4General Assembly must vote on whether to accept the report
5within 14 days after the General Assembly convenes for the
6first time after the report is filed. The Commission is
7dissolved on the day after the report is filed with both the
8Governor and the General Assembly.
9    (d) This Section is repealed on January 31, 2013.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
