SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2LLL new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act for a valet service provider to refuse a consumer's request to store his or her motor vehicle overnight when the consumer indicates that he or she is too intoxicated to safely drive the motor vehicle. Provides that the valet service shall store the consumer's motor vehicle until 12:00 p.m. of the following day and may charge a fee of not more than $30 for the additional storage of the consumer's motor vehicle.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2LLL as follows:
 
6    (815 ILCS 505/2LLL new)
7    Sec. 2LLL. Valet service provider.
8    (a) As used in this Section:
9    "Motor vehicle" has the meaning attributed to that term by
10the Illinois Vehicle Code.
11    "Short-term" means a period of time lasting not more than 6
12hours.
13    "Valet service provider" means a person who provides a
14short-term parking and storage service of a consumer's motor
15vehicle whereby a consumer typically leaves a motor vehicle at
16the entrance of a business or event and an attendant parks and
17retrieves the motor vehicle.
18    (b) A valet service provider may not refuse a consumer's
19request to store his or her motor vehicle overnight when the
20consumer indicates that he or she is too intoxicated to safely
21drive the motor vehicle. If a valet service provider accepts
22the consumer's request under this subsection, the valet service
23shall store the consumer's motor vehicle until 12:00 p.m. of

1the following day and may charge a fee of not more than $30 for
2the additional storage of the consumer's motor vehicle.
3    (c) A person who violates this Section commits an unlawful
4practice within the meaning of this Act.
