| 1 | AMENDMENT TO HOUSE BILL 1138

| 2 | AMENDMENT NO. ______. Amend House Bill 1138 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Department of Transportation Law of the
| ||||||
| 5 | Civil Administrative Code of Illinois is amended by adding | ||||||
| 6 | Section 2705-505.7 as follows: | ||||||
| 7 | (20 ILCS 2705/2705-505.7 new) | ||||||
| 8 | Sec. 2705-505.7. School zone speed limits; signs; notice. | ||||||
| 9 | Before erecting any new signs regulating speed pursuant to | ||||||
| 10 | Section 11-605 of the Illinois Vehicle Code or similar local | ||||||
| 11 | ordinance, or changing the speed limit of a roadway within | ||||||
| 12 | 2,000 feet of the primary entrance or entrances of a school or | ||||||
| 13 | schools, the Department or body having jurisdiction over the | ||||||
| 14 | roadway shall notify the principal of any schools within 2,000 | ||||||
| 15 | feet of the proposed action and the chief of the local law | ||||||
| 16 | enforcement agency. The notice shall contain (i) a description | ||||||
| |||||||
| |||||||
| 1 | of the proposed action, including the proposed speed limit | ||||||
| 2 | changes and geography involved; and (ii) a contact person to | ||||||
| 3 | whom comments may be submitted. | ||||||
| 4 | The Department or body having jurisdiction over the roadway | ||||||
| 5 | shall provide at least 30 days notice of the proposed action | ||||||
| 6 | and shall accept comments from any interested party for at | ||||||
| 7 | least 30 days. The notice shall be in the form of a letter | ||||||
| 8 | delivered by first class mail and may also be provided through | ||||||
| 9 | other means. Upon request of a school district, any notice | ||||||
| 10 | required by this Section shall be delivered to a designated | ||||||
| 11 | contact at the district instead of to individual principals. | ||||||
| 12 | Nothing in this Section shall prohibit forms of public notice, | ||||||
| 13 | public comment, or public hearings in addition to those | ||||||
| 14 | required by this Section. | ||||||
| 15 | This Section shall not apply in municipalities with a | ||||||
| 16 | population over 1,000,000 persons.
| ||||||
| 17 | Section 99. Effective date. This Act takes effect upon | ||||||
| 18 | becoming law.".
