Amends the Illinois Municipal Code. Provides that if petitions for nomination to be elected to an office have been filed for the same person for 2 or more offices that are incompatible, that person must withdraw as a candidate for all but one of those offices within the 5 business days following the last day for petition filing. If that person fails to withdraw as a candidate within that time, the person's name shall not be certified, nor printed on the ballot, for any office.

1 | | AN ACT concerning local government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 3.1-15-45 as follows: |
6 | | (65 ILCS 5/3.1-15-45 new) |
7 | | Sec. 3.1-15-45. Petitions for incompatible offices. |
8 | | Notwithstanding any other provision of law, if petitions for |
9 | | nomination have been filed for the same person for 2 or more |
10 | | offices to be elected under this Code that are incompatible so |
11 | | that the same person could not serve in more than one of those |
12 | | offices if elected, that person must withdraw as a candidate |
13 | | for all but one of those offices within the 5 business days |
14 | | following the last day for petition filing. If the person fails |
15 | | to withdraw as a candidate for all but one of the offices |
16 | | within that time, the person's name shall not be certified, nor |
17 | | printed upon the ballot, for any office.
