1 | | AN ACT concerning housing.
|
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Housing Authorities Act is amended by |
5 | | changing Section 4 as follows:
|
6 | | (310 ILCS 10/4) (from Ch. 67 1/2, par. 4)

7 | | Sec. 4.
Whenever it shall appear to the
the presiding |
8 | | officer having appointment
authority that a commissioner of a |
9 | | Housing Authority
is incompetent or guilty of
neglect of duty |
10 | | or malfeasance, the presiding officer
shall require such |
11 | | commissioner to appear before the presiding officer
or his |
12 | | designee to show
cause why he should not be removed from |
13 | | office. At least fifteen days'
written notice of such a hearing |
14 | | shall be given to the commissioner
whose conduct is in question |
15 | | and to all other members of the Authority.
At the hearing the |
16 | | commissioner may be represented by counsel and may
appear |
17 | | personally and present such pertinent evidence as he wishes or |
18 | | as
the presiding officer or his designee may request. |
19 | | If after a hearing the presiding officer
determines that a |
20 | | commissioner has been incompetent or has been guilty
of neglect |
21 | | of duty or malfeasance, he shall remove such commissioner
from |
22 | | the Authority within seven days, and there shall thereupon be
|
23 | | deemed to be a vacancy of such office.
