| 2 | | AMENDMENT NO. ______. Amend House Bill 1091 on page 7, line |
| 3 | | 25, by inserting after the period the following: |
| 4 | | "The Authority may operate or provide operational services |
| 5 | | such as toll collection on highways which are developed or |
| 6 | | financed, or both, through a public-private agreement entered |
| 7 | | into by another public entity."; and

| 8 | | on page 46, line 16, by inserting after the period the |
| 9 | | following: |
| 10 | | "To implement the powers conferred by this Act, the |
| 11 | | transportation agency may establish rules and procedures for |
| 12 | | the procurement of a public-private agreement under this Act. |
| 13 | | Nothing contained in this Act is intended to supersede |
| 14 | | applicable federal law or to foreclose the use or potential use |
| 15 | | of federal funds. In the event any provision of this Act is |
| 16 | | inconsistent with applicable federal law or would have the |
| 17 | | effect of foreclosing the use or potential use of federal |
