technical change in a Section concerning information brokers.

1    AN ACT concerning children.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 

 
4    Section 5. The Children's Privacy Protection and Parental 
5Empowerment Act is amended by changing Section 15 as follows:
 



6    (325 ILCS 17/15)



7    Sec. 15. Information brokers. 

8    (a) For the
the purpose of this Act, the consent of a 
9parent to the sale or
purchase of
information concerning a 
10child is presumed unless the parent withdraws consent
under

11this Section.
12    A person who brokers or facilitates the sale of personal 
13information
concerning
children must, upon written request 
14from a parent that specifically identifies
the child,
provide 
15to the parent within 20 days of the written request procedures 
16that the
parent
must follow in order to withdraw consent to use 
17personal information relating
to that
child. The person who 
18brokers or facilitates the sale of personal information
must

19discontinue disclosing a child's personal information within 
2020 days after the
parent has
completed the procedures to 
21withdraw consent to use personal information
relating to that

22child.

23    (b) This Section does not apply to any of the following:

1        (1) Any federal, state, or local government agency or 
2    any law enforcement
agency.


3        (2) The National Center for Missing and Exploited 
4    Children.


5        (3) Any educational institution, consortium, 
6    organization, or professional
association, including but 
7    not limited to, public community colleges, public

8    universities, post-secondary educational institutions as 
9    defined in the Private
College Act, and private business 
10    and vocational schools as defined in the
Private
Business 
11    and Vocational Schools Act.


12        (4) Any not-for-profit entity that is exempt from the 
13    payment of federal
taxes under Section 501(c)(3) of the 
14    Internal Revenue Code of 1986.
