| 6 | | amended by changing Section 1905-90 as follows:

| 8 | | Sec. 1905-90. State Mining Board. Any statute that by its

| 9 | | terms is to be administered by the State Mining
Board shall be |
| 10 | | administered by the Board without any direction,
supervision, |
| 11 | | or
control by the Director of Natural Resources or the Director |
| 12 | | of
the Office of Mines and Minerals, except that which the |
| 13 | | Director of Natural Resources, or his or her designee, the
|
| 14 | | Office may, pursuant to Section 2.08 of the Coal Mining Act, |
| 15 | | exercise by virtue of being a member of the Board
and except as |
| 16 | | may be provided in that Act the statute.
