AMENDMENT TO HOUSE BILL 304

2    AMENDMENT NO. ______. Amend House Bill 304 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Community College Act is amended by
5changing Section 6-4 as follows:
 
6    (110 ILCS 805/6-4)  (from Ch. 122, par. 106-4)
7    Sec. 6-4. Variable rates and fees.
8    (a) Any community college district, by resolution of the
9board, may establish variable tuition rates and fees for
10students attending its college in an amount not to exceed 1/3
11of the per capita cost as defined in Section 6-2, provided that
12voluntary contributions, as defined in Section 65 of the Higher
13Education Student Assistance Act, shall not be included in any
14calculation of community college tuition and fee rates for the
15purpose of this Section.
16    (b) Through June 30, 2014, a board notified by the State

1Board to be exceeding the 1/3 per capita cost limitation under
2subsection (a) of this Section may, by proper resolution
3following a public hearing set by the board or the chairperson
4of the board (that is preceded (i) by at least one published
5notice over the name of the clerk or secretary of the board,
6occurring at least 7 days and not more than 30 days prior to
7the hearing, in a newspaper of general circulation within the
8community college district and (ii) by posted notice over the
9name of the secretary of the board, at least 48 hours before
10the hearing at the principal office of the community college
11district or at the building where the hearing is to be held if
12a principal office does not exist, setting forth the time,
13date, place, and subject matter of the hearing), waive the
14tuition rate and fee limitation of 1/3 of the per capita cost.
15The State Board shall determine, through examination of annual
16financial audit reports submitted by the community college
17districts, where the need exists to increase tuition under this
18amendatory Act of the 97th General Assembly.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
