Amends the Illinois Vehicle Code. Provides that every operator and passenger
on a motorcycle, motor driven cycle, or motorized pedalcycle

|
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing
|
5 | | Section 11-1404 as follows:
|
6 | | (625 ILCS 5/11-1404) (from Ch. 95 1/2, par. 11-1404)

7 | | Sec. 11-1404. Special equipment for persons riding |
8 | | motorcycles, motor
driven cycles , or mopeds. |
9 | | (a) The operator and every passenger of a motorcycle, motor
|
10 | | driven cycle , or moped must wear a helmet which meets the |
11 | | requirements of Federal Motor Vehicle Safety Standard No. 218, |
12 | | and must and every passenger thereon shall be
protected by |
13 | | glasses, goggles , or a transparent shield. The helmet |
14 | | requirement contained in this subsection (a) shall only apply |
15 | | to persons age 26 or younger.

16 | | (b) For the purposes of this Section, glasses, goggles, and |
17 | | transparent
shields are defined as follows:
|
18 | | "Glasses" means ordinary eye pieces such as spectacles or |
19 | | sunglasses worn
before the eye, made of shatter-resistant |
20 | | material.
Shatter-resistant material, as used in this Section, |
21 | | means material so
manufactured, fabricated, or
created that it |
22 | | substantially prevents shattering or flying when struck or
|
23 | | broken.
