Amends the County Jail Act. Provides that at any time, in the opinion of the Warden, the lives or health
of the prisoners are endangered or the security of the penal institution is threatened (rather than just the lives or health
of the prisoners are endangered), to such a degree as to render their removal
necessary, the Warden may cause an individual prisoner or group of prisoners (rather than the prisoners) to be removed to some suitable
place within the county, or to the jail of some convenient county, where
they may be confined until they can be safely returned to the place whence
they were removed.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The County Jail Act is amended by changing |
5 | | Section 14 as follows:
|

7 | | Sec. 14.
At any time, in the opinion of the Warden, the |
8 | | lives or health
of the prisoners are endangered or the security |
9 | | of the penal institution is threatened , to such a degree as to |
10 | | render their removal
necessary, the Warden may cause an |
11 | | individual prisoner or a group of the prisoners to be removed |
12 | | to some suitable
place within the county, or to the jail of |
13 | | some convenient county, where
they may be confined until they |
14 | | can be safely returned to the place whence

15 | | No prisoner charged with a felony shall be removed by
the |
16 | | warden to a Mental Health or Developmental Disabilities |
17 | | facility as
defined in the Mental Health and Developmental |
18 | | Disabilities Code, except as
specifically authorized by |
19 | | Article 104 of the Code of Criminal Procedure of
1963, or the |
20 | | Mental Health and Developmental Disabilities Code. Any place
to |
21 | | which the prisoners are so removed shall,
during their |
22 | | imprisonment there, be deemed, as to such prisoners, a prison

23 | | of the county in which they were originally confined; but, they |
