SYNOPSIS AS INTRODUCED:
 
5 ILCS 490/37 new
625 ILCS 5/3-637

    Amends the State Commemorative Dates Act to designates the second Thursday in April of each year as D.A.R.E. Day. Amends provisions of the Illinois Vehicle Code concerning D.A.R.E. special registration plates. Provides that all money in the State D.A.R.E. Fund shall be paid, subject to appropriation by the General Assembly and approval by the Secretary of State, as grants to the Illinois D.A.R.E. Officers Association for its D.A.R.E. program (rather than being distributed to the Illinois State Police for its D.A.R.E. program). Provides that distributions from the County D.A.R.E. Fund to counties for their D.A.R.E. programs and from the Municipal D.A.R.E. Fund to municipalities for their D.A.R.E. programs shall be made by the Secretary of State (rather than being made by the Illinois State Police). Effective immediately.

1    AN ACT concerning D.A.R.E. Programs.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Commemorative Dates Act is amended by
5adding Section 37 as follows:
 
6    (5 ILCS 490/37 new)
7    Sec. 37. D.A.R.E. Day. The second Thursday in April of each
8year is designated as D.A.R.E. Day.
 
9    Section 10. The Illinois Vehicle Code is amended by
10changing Section 3-637 as follows:
 
11    (625 ILCS 5/3-637)
12    Sec. 3-637. D.A.R.E. license plate.
13    (a) The Secretary, upon receipt of an application made in
14the form prescribed by the Secretary of State, may issue
15special registration plates designated to be D.A.R.E. (Drug
16Abuse Resistance Education) license plates. The special plates
17issued under this Section shall be affixed only to passenger
18vehicles of the first division, motor vehicles of the second
19division weighing not more than 8,000 pounds, and recreational
20vehicles as defined by Section 1-169 of this Code. Plates
21issued under this Section shall expire according to the

1multi-year procedure established by Section 3-414.1 of this
2Code.
3    (b) The design and color of the plates shall be wholly
4within the discretion of the Secretary of State. Appropriate
5documentation, as determined by the Secretary, shall accompany
6the application. The Secretary may, in his or her discretion,
7allow the plates to be issued as vanity or personalized plates
8in accordance with Section 3-405.1 of this Code.
9    (c) An applicant shall be charged a $45 fee for original
10issuance in addition to the appropriate registration fee, if
11applicable. Of this fee, $10 shall be deposited into the State
12D.A.R.E. Fund; $10 shall be deposited into the County D.A.R.E.
13Fund if the county, as indicated by the applicant's address,
14has a D.A.R.E. program, otherwise the $10 fee shall be
15deposited into the State D.A.R.E. Fund; $10 shall be deposited
16into the Municipal D.A.R.E. Fund if the municipality, as
17indicated by the applicant's address, has a D.A.R.E. program,
18otherwise the $10 fee shall be deposited into the County
19D.A.R.E. Fund if the county, as indicated by the applicant's
20address, has a D.A.R.E. program, otherwise the $10 fee shall be
21deposited into the State D.A.R.E. Fund; and $15 shall be
22deposited into the Secretary of State Special License Plate
23Fund.
24    For each registration renewal period, a $29 fee, in
25addition to the appropriate registration fee, shall be charged.
26Of this fee, $9 shall be deposited into the State D.A.R.E.

1Fund; $9 shall be deposited into the County D.A.R.E. Fund if
2the county, as indicated by the applicant's address, has a
3D.A.R.E. program, otherwise the $9 fee shall be deposited into
4the State D.A.R.E. Fund; $9 shall be deposited into the
5Municipal D.A.R.E. Fund if the municipality, as indicated by
6the applicant's address, has a D.A.R.E. program, otherwise the
7$9 fee shall be deposited into the County D.A.R.E. Fund if the
8county, as indicated by the applicant's address, has a D.A.R.E.
9program, otherwise the $9 fee shall be deposited into the State
10D.A.R.E. Fund; and $2 shall be deposited into the Secretary of
11State Special License Plate Fund.
12    (d) The State D.A.R.E. Fund is created as a special fund in
13the State Treasury. All money in the State D.A.R.E. Fund shall
14be paid, subject to appropriation by the General Assembly and
15approval by the Secretary, as grants distributed, subject to
16appropriation by the General Assembly, to the Illinois D.A.R.E.
17Officers Association State Police for its D.A.R.E. program.
18    The County D.A.R.E. Fund is created as a special fund in
19the State Treasury. All money in the County D.A.R.E. Fund shall
20be distributed, subject to appropriation by the General
21Assembly, to the Secretary Illinois State Police. The Secretary
22Illinois State Police shall make grants of this money to
23counties for their D.A.R.E. programs based on the proportion of
24money the County D.A.R.E. Fund has received from each county,
25as indicated by the applicant's address.
26    The Municipal D.A.R.E. Fund is created as a special fund in

1the State Treasury. All money in the Municipal D.A.R.E. Fund
2shall be distributed, subject to appropriation by the General
3Assembly, to the Secretary Illinois State Police. The Secretary
4Illinois State Police shall make grants of this money to
5municipalities for their D.A.R.E. programs based on the
6proportion of money the Municipal D.A.R.E. Fund has received
7from each municipality, as indicated by the applicant's
8address.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.
