|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 1961 is amended by changing |
| 5 | | Section 20-2 as follows:
|
| 6 | | (720 ILCS 5/20-2) (from Ch. 38, par. 20-2)
|
| 7 | | Sec. 20-2. Possession of explosives or explosive or |
| 8 | | incendiary devices.
|
| 9 | | (a) A person commits the
the offense of possession of |
| 10 | | explosives or
explosive or incendiary devices in violation of |
| 11 | | this Section when he or she
possesses, manufactures or |
| 12 | | transports
any explosive compound, timing or detonating device |
| 13 | | for use with any explosive
compound or incendiary device
and |
| 14 | | either intends to use such explosive or device to commit any |
| 15 | | offense or
knows that another intends to use such explosive or |
| 16 | | device to commit a
felony. |
| 17 | | (b) Sentence.

| 18 | | Possession of explosives or explosive or incendiary |
| 19 | | devices in violation
of this Section is a Class 1 felony for |
| 20 | | which a person, if
sentenced to a term of imprisonment, shall |
| 21 | | be sentenced to not less than 4
years and not more than 30 |
| 22 | | years.
