Synopsis As Introduced
Creates the Adopt-A-Park Act. Establishes a program that allows private citizens to support municipal, township, county, and State anti-litter efforts by allowing groups to adopt a park or a section of a park for the purpose of litter collection. Creates provisions concerning definitions; participation in Adopt-A-Park program; agreements to Adopt-A-Park; responsibilities of the group; responsibilities of the sponsoring jurisdiction; signs identifying sections or parks adopted by a group; safety training for groups; other conditions a sponsoring jurisdiction may implement; and additional penalties for violating the Litter Control Act. Effective July 1, 2012.

Replaces everything after the enacting clause. Amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois. Provides that the Department shall (rather than may) establish and maintain Adopt-A-Park programs with individual or group volunteers, if requested by the individual or group volunteers. Provides that the Department shall retain the ability to approve or deny an individual or group volunteer's request; however, the Department must state the reason for the request denial. Provides that the Department may request that the individual or group volunteer's pay for a sign that identifies those volunteers adopting a particular park and park lands. Provides that the State and the Department and its employees are not liable for any damages or injury suffered by any person resulting from his or her participation in the program or from the actions or activities of the volunteers. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinserts the engrossed bill with changes. Further amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois. Requires individuals and group volunteers to bring their own reflective safety gear (instead of having the Department provide safety briefings and the reflective safety gear). Requires the Department to provide a certificate of appreciation to individual or group volunteers in recognition of their Adopt-A-Park efforts at a particular Department site (instead of requiring the Department to provide and install signs identifying volunteers that have adopted a particular park or park lands). Provides that volunteer services shall not include work historically performed by Department employees nor shall volunteer services be inconsistent with the terms of a collective bargaining agreement. Prohibits the State and the Department, its directors, employees, and agents from being held liable for any damages or injury suffered by any person as a result of his or her participation in the program or the actions or activities of volunteers, except in cases of willful and wanton misconduct. Requires any group, as well as its individual members who wish to volunteer, and any individual who wishes to volunteer to execute a general release and hold harmless agreement before beginning any volunteer activity or work. Requires an officer, director, or other representative of such a group to execute a general release and hold harmless agreement on behalf of the group. Effective immediately.
