Synopsis As Introduced
Amends the Illinois Administrative Procedure Act. Exempts certain guidance documents issued by the Environmental Protection Agency from the definition of "rules". Amends the Public Utilities Act. Removes provisions requiring the Agency: (i) to inspect carbon dioxide sequestration sites each year, (ii) to seal such a site if it determines that the site creates conditions that warrant the issuance of a seal order, (iii) to request the State's Attorney or the Attorney General to institute a civil action if the Agency determines a site creates conditions warranting such an action. Removes provisions (i) requiring a Substitute Natural Gas (SNG) facility to incur all reasonable costs associated with any Agency inspection or monitoring of the sequestration sites, (ii) prohibiting those costs from being passed along to customers, and (iii) requiring the facility to cooperate with Agency investigations. Removes a provision authorizing the Agency to monitor and conduct investigations of SNG facilities. Amends the Environmental Protection Act. Increases laboratory fees and assessments. Removes a provision requiring the Agency to submit its assessment schedules to the Environmental Laboratory Certification Committee. Makes changes concerning the terms of members of the Environmental Laboratory Certification Committee and the frequency of the Committee's meetings. Provides that, beginning January 1, 2013, the Environmental Protection Agency shall issue 3-year Special Waste Hauling Permits (instead of annual Special Waste Hauling Permits). Increases the fee for each waste hauling vehicle identified in the permit application and for each vehicle that is added to the permit during the 3-year period. Makes other changes. Effective immediately.

Further amends the Environmental Protection Act. Removes provisions that exempted the Illinois Pollution Control Board's small source program rules from certain rulemaking requirements in the Environmental Protection Act and the Illinois Administrative Procedure Act.

Senate Floor Amendment No. 4
Requires carbon dioxide emission credits equivalent to 50% of the amount of credits associated with the required sequestration of carbon dioxide from a facility to be permanently retired. Requires compliance with the sequestration requirements and the offset purchase requirements to be assessed annually by an independent expert retained by the owner of the SNG facility, with the advance written approval of the Attorney General. Authorizes the Illinois Commerce Commission to approve a carbon dioxide sequestration method if the owner or operator of the sequestration site has received a permit that is similar to an Underground Injection Control permit.

House Committee Amendment No. 1
Restores provisions, which were deleted in the engrossed, that require the Illinois Environmental Protection Agency to inspect all carbon dioxide sequestration sites in Illinois and to issue seal orders under certain circumstances.

 Fiscal Note, House Committee Amendment No. 1 (Illinois Environmental Protection Agency)
 SB 2867 would be revenue neutral to the Illinois Environmental Protection Agency. Specifically, the threefold increase in the annual special waste hauler fee is revenue neutral since the duration of the permits would be extended from one to three years. The laboratory certification testing fees simply codify the identical fees currently in rule. None of the other provisions in this bill would have any fiscal impact on the Illinois EPA.

House Floor Amendment No. 2
Provides that the prohibition on the construction and installation of certain surface discharging private sewage disposal systems, without the proper authorizations, takes effect beginning January 1, 2013 or 6 months after the date of issuance of a general NPDES permit for surface discharging private sewage disposal systems by the Illinois Environmental Protection Agency or by the United States Environmental Protection Agency, whichever is later (now, that prohibition takes effect January 1, 2013).
