Synopsis As Introduced
Amends the Code of Criminal Procedure of 1963 relating to progress reports of defendants found unfit to stand trial. Provides that whenever the court is sent a report from the supervisor of the defendant's treatment, the treatment provider shall arrange for the return of the defendant to the county jail within a specified period before the discharge hearing. Provides that the discharge hearing shall be held within 14 (rather than 120) days of the filing of a motion for a discharge hearing, unless good cause is demonstrated why the hearing cannot be held or the delay is occasioned by the defendant. Effective immediately.

Adds reference to:
20 ILCS 1305/1-60 new

Replaces everything after the enacting clause. Amends the Department of Human Services Act. Provides that the Department of Human Services shall prepare 2 reports on the impact of the new provisions of the Code of Criminal Procedure of 1963. Provides that a preliminary report shall be prepared and submitted to the Governor and the General Assembly by November 1, 2012. Provides that a final report shall be prepared and submitted to the Governor and the General Assembly by October 1, 2013. Each report shall be posted on the Department's website within a week of its submission. Provides that each report shall discuss the number of admissions during the reporting period, any delay in admissions, the number of persons returned to the county under the new provisions of the Code of Criminal Procedure of 1963, and any issues the county sheriffs or other county officials are having with the returns. Provides that each report shall include a recommendation from the Department of Human Services and one from an association representing Illinois sheriffs whether to continue the pilot study. Provides that if either report indicates that there are serious deleterious effects from the new provisions of the Code of Criminal Procedure of 1963 or that the new provisions of the Code of Criminal Procedure of 1963 are not producing adequate results, the General Assembly may take necessary steps to eliminate the new provisions prior to January 1, 2014. Amends the Code of Criminal Procedure of 1963. Provides that whenever the court is sent a report from the supervisor of the defendant's treatment in which the treatment supervisor believes that the defendant has attained fitness, the treatment provider shall arrange with the court for the return of the defendant to the county jail before the 90 day period. Provides that the new provision is inoperative on and after January 1, 2014. Effective immediately.
