Replaces everything after the enacting clause. Amends the Environmental Protection Act. Excludes from the definition of "municipal waste incineration" the burning of fuel excluded from the definition of "solid waste" under a specific federal regulation. Excludes from the definition of "new municipal waste incinerator" any facility that uses a fuel excluded from the definition of "solid waste" under that regulation. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Environmental Protection Act. In provisions concerning municipal waste incineration emission standards, provides that municipal waste and fuel derived from municipal waste do not include non-hazardous secondary material that is excluded from solid waste when used legitimately as a fuel or ingredient in a combustion unit in accordance with certain federal standards and criteria. Provides, for the purposes of these provisions, that either the United States Environmental Protection Agency (USEPA) or the Illinois Pollution Control Board will make determinations regarding whether a material is solid waste. Specifies requirements that apply when the Board makes such a determination. In provisions concerning municipal waste incinerators, specifies that "municipal waste incinerator" is synonymous with "municipal waste incineration facility". Effective immediately.
