Synopsis As Introduced
Amends the Chicago Teachers Article of the Illinois Pension Code. Changes the method for calculating validated service. Limits the amount of pension credit that may be granted each year. Authorizes deductions for omissions made in prior pay periods. Requires deductions to be made whenever salary represents pay for a day or part of a day (rather than pay for 5 days). Makes other changes concerning the administration of payroll deductions. Requires employers to cause the Fund to receive all payroll records and pension contributions (rather than just pension contributions) within 30 calendar (rather than 15 business) days after each predesignated payday. Makes other changes concerning the payment and certification of salary deductions. Amends the State Mandates Act to require implementation without reimbursement. Effective July 1, 2011.

Amends the Open Meetings Act. Requires employers participating in the Illinois Municipal Retirement Fund (IMRF) to post the total compensation package of employees making more than the specified amounts. Amends the General Provisions, Downstate Police, Downstate Firefighter, IMRF, State Employees, and Miscellaneous Administrative Provisions Articles of the Illinois Pension Code. In the General Provisions Article: (1) provides that if a new hire is receiving a retirement annuity or pension and accepts a contractual position to provide services to a governmental entity from which he or she has retired, then that person's annuity or pension will be suspended during that contractual service and (2) makes it a Class A misdemeanor for a pensioner who is seeking contractual employment to fail to notify certain persons about his or her retirement status before accepting an employment contract. In the Downstate Police Article and Downstate Firefighter Articles, authorizes each fund to transfer fund investment functions to the IMRF. In the IMRF Article: (1) deletes a provision that requires the authorized agent of a participating municipality or participating instrumentality to be a member of the fund; (2) deletes a provision that prohibited certain employers from electing a 1,000-hour participation standard based on their original date of participation; (3) authorizes retired members who return to work for an IMRF employer to keep their pension even if employed in a position requiring less than the employer's standard for participation in IMRF; (4) prohibits a sheriff's law enforcement employee who begins service in that capacity after the effective date of the amendatory Act from being able to convert up to 10 years of service in any other capacity into service as a sheriff's law enforcement employee; (5) provides that, on and after the effective date of the amendatory Act, an elected county officer will not be able to elect to establish alternative credits for an alternative annuity; (6) changes the computation of final rate of earnings; (7) provides, except under specified circumstances, that if the amount of a participating employee's earnings for any calendar year used to determine the participating employee's retirement annuity exceeds the amount of his or her earnings with the same participating municipality or participating instrumentality for the previous calendar year by more than 6%, then the participating municipality or participating instrumentality must pay to the fund the present value of the increase in benefits resulting from the portion of the increase in earnings that is in excess of 6%; (8) makes changes in the way the annuity reserve is calculated if a retiring employee has accumulated service in more than one participating municipality or participating instrumentality; (9) requires the corporate authorities of a municipality, before increasing the salary of a municipal officer, executive, or manager, to receive certain pension-related information from the Illinois Municipal Retirement Fund and to sign a statement acknowledging the receipt of that information; and (10) changes the definition of "employee" to include certain participants in Taft-Hartley pension plans. In the State Employees Article: prohibits a person who on or after the effective date of the amendatory Act first becomes a member of one of the specified boards from participating in the pension plan created under that Article. In the Miscellaneous Administrative Provisions Article: prohibits persons who first sit on the boards of the Chicago Transit Authority (CTA), Regional Transportation Authority (RTA), Suburban Bus Division, or Commuter Rail Division on or after the effective date of the amendatory Act from participating in the pension plans provided for those entities. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Further amends the Downstate Police, Downstate Firefighter, and the Illinois Municipal Retirement Fund (IMRF) Articles of the Illinois Pension Code. Removes provisions authorizing Downstate Police and Downstate Firefighter funds to voluntarily turn over the management of fund assets to the Illinois Municipal Retirement Fund. Provides that the bill takes effect on January 1, 2012 (rather than immediately), with the exception of the changes made to specified provisions in the Illinois Municipal Retirement Fund Article that take effect upon becoming law.
