Synopsis As Introduced
Amends the State Employees Group Insurance Act of 1971. Provides that in order to be eligible for group insurance benefits under a retirement system: (i) each annuitant or retired employee must meet the vesting requirements of the applicable retirement system and (ii) each survivor must establish that the deceased employee, annuitant, or retired employee upon whom the annuity is based was eligible to participate in the group insurance system under the applicable retirement system. Specifies that certain persons do not qualify as community college dependent beneficiaries or TRS dependent beneficiaries. Provides that only employees (rather than employees, annuitants, retired employees, and survivors) and their elected dependents are eligible and covered for all benefits available under the Act's programs. Provides that annuitants, survivors, and retired employees and their elected dependents are immediately eligible for the group health benefits program and that the coverage of those persons is effective immediately upon the completion of the required forms. Requires, however, each survivor who is seeking coverage under that program to establish that he or she would have been eligible for coverage under the deceased member upon whom the survivor's annuity is based.

Replaces everything after the enacting clause. Amends the State Employees Group Insurance Act of 1971. Reinserts the provisions of the introduced bill with changes. Provides that the changes made by the amendatory Act apply only to persons who become members of the affected classes of persons on or after the effective date of the amendatory Act.

Replaces everything after the enacting clause. Amends the Illinois Public Labor Relations Act. Exempts legislative liaisons and specified classes of State employees from the definition of public employee under the Act. Provides that with respect only to State employees in positions under the jurisdiction of the Attorney General, Secretary of State, Comptroller, or Treasurer (i) that are certified in a bargaining unit on or after December 2, 2008, (ii) for which a petition is filed with the Illinois Public Labor Relations Board on or after the effective date of the amendatory Act, or (iii) for which a petition is pending before the Illinois Public Labor Relations Board on that date: "managerial employee" means an individual who is engaged in executive and management functions or who is charged with the effectuation of management policies and practices or who represents management interests by taking or recommending discretionary actions that effectively control or implement policy, and "supervisor" means an employee who qualifies as a supervisor under a specific provision of the National Labor Relations Act and orders of the National Labor Relations Board interpreting that provision or decisions of courts reviewing the decisions of the National Labor Relations Board. Prohibits persons excluded from the definition of public employee from collectively bargaining. Authorizes the Governor to exclude a specified number of State employment positions from the self-organization and collective bargaining provisions of the Act. Specifies the types of positions that are eligible to be excluded by the Governor and the conditions upon which positions may be excluded. Effective immediately.
