Synopsis As Introduced
Amends the Employee Washroom Act. Makes a technical change in a Section concerning the short title.

Senate Committee Amendment No. 1
Deletes reference to:
820 ILCS 230/0.01
Adds reference to:
820 ILCS 305/1from Ch. 48, par. 138.1

Replaces everything after the enacting clause. Amends the Workers' Compensation Act. Provides that the term "employee" does not include a person or his or her dependents with a cause of action by reason of any injury, disablement, or death arising out of and in the course of his or her employment when that injury, disablement, or death occurred during his or her commission of a forcible felony, aggravated driving under the influence of alcohol, other drug or drugs, or intoxicating compound or compounds, or any combination thereof, or reckless homicide if that forcible felony, aggravated driving under the influence, or reckless homicide caused an accident resulting in the death or severe injury of another person. Effective immediately.

Senate Committee Amendment No. 2
Changes the exclusion to the definition of "employee" in Senate Amendment No. 1 by adding an additional requirement that the injury, disablement, or death occurred "during and as a proximate result" (rather than only "during") the person's commission of one of the specified criminal acts.

Senate Floor Amendment No. 3
Deletes reference to:

Adds reference to:
820 ILCS 305/11from Ch. 48, par. 138.11

Replaces everything after the enacting clause. Amends the Workers' Compensation Act. Provides that accidental injuries incurred while an employee is engaged in the active commission of and as a proximate result of the active commission of (a) a forcible felony, (b) aggravated driving under the influence of alcohol, other drug or drugs, or intoxicating compound or compounds, or any combination thereof, or (c) reckless homicide and for which the employee was convicted do not arise out of and in the course of employment if the commission of that forcible felony, aggravated driving under the influence, or reckless homicide caused an accident resulting in the death or severe injury of another person. Provides that there shall be no presumption that the employee is eligible for benefits under this Act when the employee is acquitted of those same offenses. Provides that an employee shall not be entitled to additional compensation under specific sections of the Act pertaining to delays in payment when the employee has been charged with the provided offenses causing an accident resulting in the death or severe injury of another person and the employer terminates benefits until the conclusion of any pending criminal proceedings. Effective immediately.

Senate Floor Amendment No. 4
Provides that an employee is not entitled to attorney's fees when the employee has been charged with one of the listed offenses causing an accident resulting in the death or severe injury of another person and the employer terminates benefits until the conclusion of any pending criminal proceedings.
