Replaces everything after the enacting clause. Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that specified increased payments and assessments for long-term care providers are not due and payable until after the Department of Healthcare and Family Services notifies the long-term care providers, in writing, that the payment methodologies to long-term care providers required under specified provisions of the Code have been approved by the Centers for Medicare and Medicaid Services of the U.S. Department of Health and Human Services and that federal waivers for the assessment imposed under specified provisions of the Code have been granted by the Centers for Medicare and Medicaid Services of the U.S. Department of Health and Human Services. Applies similar restrictions on the disbursement of specified money transfers from the Long-Term Care Provider Fund. Effective immediately.

Replaces everything after the enacting clause with the engrossed bill and the following changes. Creates the Specialized Mental Health Rehabilitation Act and amends the Nursing Home Care Act. Provides that all long-term care facilities for the mentally ill shall be licensed by the Department of Public Health under the Specialized Mental Health Rehabilitation Act instead of under the Nursing Home Care Act. Makes the provisions in the Specialized Mental Health Rehabilitation Act substantially the same as those in the Nursing Home Care Act, including provisions for the rights of residents and responsibilities of facilities, licensing, violations and penalties, and transfer or discharge of residents. Amends various Acts to make conforming changes. Effective immediately.

 SB 769 (H-AM 1) will have a fiscal impact on the Department of Public Health estimated in the amount of $368,040.00 to acquire additional staff.

Provides that, beginning with dates of service on or after July 1, 2011, the Department shall by rule establish reimburse rates for licensed ground ambulance providers at 90% of the 2011 Medicare emergency services base mileage rate, excluding any adjustment for rural/urban pickup differences, for loaded miles for approved non-emergency services and 50% of the 2011 Medicare emergency services base mileage rate, excluding any adjustment for rural/urban pickup differences, for loaded miles for approved emergency services. Effective immediately.
