Replaces everything after the enacting clause. Amends the Illinois Lottery Law by transferring the powers of the Division of the Lottery within the Department of Revenue to the Department of the Lottery and makes related changes. Provides for oversight of the private manager by the Chief Procurement Officer. Makes corresponding changes in the Civil Administrative Code of Illinois, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, and the Illinois Department of Revenue Sunshine Act.

Senate Floor Amendment No. 2
Adds reference to:

Further amends the Illinois Lottery Law. Provides that if for any reason the General Assembly fails to make appropriations of amounts sufficient from the State Lottery Fund to the Department for payment of prizes to holders of winning lottery tickets or shares, including prizes related to Multi-State Lottery games, and payment of promotional or incentive prizes associated with the sale of lottery tickets, then the provision constitutes an irrevocable and continuing appropriation of all amounts necessary for that purpose, and the irrevocable and continuing authority for and direction to the Comptroller and to the Treasurer of the State to make the necessary transfers out of and disbursements from the State Lottery Fund for that purpose. In provisions establishing the Department of Lottery, provides that the transferring of certain employees and certain unexpended appropriations and balances and other funds shall be at the discretion and direction of the Superintendent of the Division of the State Lottery of the Department of Revenue (instead of the Governor). Provides that the bill, as amended, shall take effect July 1, 2011.

In the Illinois Lottery Law, removes provisions concerning the State Lottery Fund.

House Floor Amendment No. 3
Replaces everything after the enacting clause with the engrossed bill with the following changes. Further amends the Illinois Lottery Law. Provides an annual salary for the Superintendent of $142,000. Provides for the designation of an Acting Superintendent during the absence or inability to act of the Superintendent, or in the case of a vacancy in the office of Superintendent until a successor is appointed and qualified. Makes changes in provisions concerning the qualifications of the Superintendent, the requirement that the Department provide to the Chief Procurement Officer a complete and un-redacted copy of the management agreement or any contract, and selection of the final offeror. Makes changes concerning the Department's reporting and information request requirements. Provides that, on the effective date of the amendatory Act (rather than on July 1, 2011), all powers, duties, rights, and responsibilities of the Division of the Lottery within the Department of Revenue shall be transferred to the Department of the Lottery, and makes related changes. Makes other changes. Provides that certain provisions are effective immediately, and the remainder are effective on October 15, 2011.
