Synopsis As Introduced
Amends the Soil and Water Conservation Districts Act. Makes a technical change to a Section concerning the short title.

Senate Committee Amendment No. 1

65 ILCS 5/11-124-5

Replaces everything after the enacting clause. Amends the Illinois Municipal Code. Provides that where a water system that is owned by a public utility provides water to customers located in 2 or more municipalities, the system may be acquired by a majority (instead of "either or all") of the municipalities by eminent domain, and if the system is to be acquired by more than one municipality, then there must be an intergovernmental agreement. Further provides that any water system acquired by a municipality or municipalities shall have any work on the system performed by employees who are members of a collective bargaining unit. Effective immediately.

Senate Floor Amendment No. 2
Adds reference to:
5 ILCS 315/3from Ch. 48, par. 1603

Replaces everything after the enacting clause. Amends the Illinois Public Labor Relations Act. Provides that the Board must recognize a labor organization as the exclusive representative of the employees of an acquired water system where there was a historical pattern of representation by that organization. Further amends the Illinois Municipal Code. Requires a municipality that acquires a water system to offer available positions to qualified employees of the system. Effective immediately.

 Correctional Note (Dept of Corrections)
 The penalty enhancements associated with SB 83 would have no fiscal or population impact on the Department.

 No land conveyances are included in this bill, therefore, there are no appraisals to be filed.

 This Bill does not have any significant fiscal impact to the State.

  SB 83 will have no fiscal impact on any pension funds or retirement systems in Illinois.

  SB 83 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.
