Synopsis As Introduced
Amends the Illinois Health Facilities Planning Act. Sets forth the requirements for the review of a permit application to establish, construct, or modify a health care facility. Provides that the Health Facilities and Services Review Board shall afford an opportunity for a public hearing concerning a permit application. Sets forth the requirements for post-permit reports. Extends the deadline for the Health Facilities and Services Review Board to establish certain rules concerning long-term care to September 30, 2011. Provides that a permit holder who fails to comply with certain post-permit and reporting requirements shall be fined an amount not to exceed $10,000 plus an additional $10,000 for each 30-day period, or fraction thereof, that the violation continues. Makes other changes.

Senate Committee Amendment No. 1
Further amends the Illinois Health Facilities Planning Act. Provides that the Health Facilities and Services Review Board shall, upon request, afford an opportunity for a public hearing within a reasonable amount of time after receipt of a complete permit application to establish, construct, or modify a health care facility. Provides that the Health Facilities and Services Review Board shall review within 120 days projects to construct (i) a new or replacement health care facility located on a new site or (ii) a replacement health care facility located on the same site as the original health care facility and the cost of the replacement healthcare facility exceeds the capital expenditure minimum. Provides that, beginning 6 months after the effective date of the amendatory Act, the Health Facilities and Services Review Board shall notify, in writing, a permit holder of the due date for the post-permit requirements no later than 30 days before the due date for the requirements.

House Committee Amendment No. 1
Further amends the Illinois Health Facilities Planning Act. Restores language providing that health care facility construction projects may deviate from the costs, fees, and expenses provided in their project cost information for the project's cost components, provided that the final total project cost does not exceed the approved permit account. Provides that project alterations shall not increase the total approved permit amount by more than the limit set forth under the rules of the Health Facilities and Services Review Board.

Further amends the Illinois Health Facilities Planning Act. Provides that the Act does not apply to public hospitals and health clinics operated by a county with a population of 3,000,000 or more inhabitants or by a governing authority established by the board of commissioners of a county with a population of 3,000,000 or more inhabitants. Provides that the Health Facilities and Services Review Board may require these public hospitals and health clinics to report statistical and other information to the Board to be used to conduct statewide inventories of health care facilities.

If the Illinois Health Facilities and Service Review Board no longer had jurisdiction over public hospitals operated by a county with a population of 3,000,000 or more inhabitants or by a governing authority established by the board of commissioners of a county with the same population, the potential loss of current and future revenues for the Board would be: (1) Closure of Oak Park Hospital - $2500.00 fee; (2) Closure of any other county hospital - $2500.00 fee; (3) Discontinuation of any category of service - $2500.00 fee per service; (4) Modernization of any county hospital - $100,000.00 fee (*The exact amount of the fee depends on the total cost of the project. If the project cost exceeded $50,000,000 the fee would be $100,000); (5) Establishment of a new county facility - $100,000.00 fee (*The exact amount of the fee depends on the total cost of the project. If the project cost exceeded $50,000,000 the fee would be $100,000). Deletes everything after the enacting clause. Provides for the conveyance by the Adjunct General on behalf of the State designated parcels of real property to Salem and Mt. Vernon, but only after the Adjunct General determines that the new Readiness Center in Salem is completed and occupied by military units and determines that the properties in Salem and Mt. Vernon are no longer required for military purposes. Amends the Military Code of Illinois. Creates the Illinois National Guard State Active Duty Fund. Provides that at the request of the Adjutant General of the Department of Military Affairs, the State Treasurer and the State Comptroller shall transfer to the Illinois National Guard State Active Duty Fund from the Federal Support Agreement Revolving Fund the reimbursement from the federal government for State Fiscal Year 2011 expenditures from the General Revenue Fund in excess of $2,200,000 for expenses related to the Lincoln's Challenge Program. Makes other changes. Amends the Veterans' Health Insurance Program Act of 2008. Repeals January 1, 2012 repealer date. Effective immediately.
