Synopsis As Introduced
Amends the Illinois Plumbing License Law. Provides that "plumbing" includes rainwater harvesting distribution systems, but does not include any rainwater harvesting distribution system or rainwater harvesting collection system unless otherwise required by the Illinois Plumbing Code. Requires the Illinois Department of Public Health to adopt and publish a minimum code of standards for rainwater harvesting collection systems and rainwater harvesting distribution systems by January 1, 2012. Requires rainwater harvesting collection systems and rainwater harvesting distribution systems to be (A) used only for non-potable uses and (B) constructed in accordance with the Illinois Plumbing Code. Defines "rainwater harvesting collection system" and "rainwater harvesting distribution system". Effective immediately.

Replaces everything after the enacting clause. Amends the Funeral Directors and Embalmers Licensing Code. Provides that beginning January 1, 2016 licensees who have engaged in the practice of funeral directing or funeral directing and embalming shall be exempt from continuing education requirements; however, those with less than 40 years shall no longer be exempt from the continuing education requirements. Creates provisions concerning the endorsement of a funeral director and embalmer license; the inactive status of a funeral director or funeral director and embalmer; and the consent to an Administrative Supervision order by a licensee. Provides that the Secretary of the Department of Financial and Professional Regulation may temporarily suspend the license of a licensee without a hearing if the Secretary finds that the public interest, safety, or welfare requires such emergency action. Provides that a person not licensed under the Code who is an owner of a funeral establishment or funeral business shall not aid, abet, assist, procure, advise, employ, or contract with any unlicensed person to offer funeral services or aid, abet, assist, or direct any licensed person contrary to or in violation of any rules or provisions of the Code. Creates a provision concerning the confidentiality of all information collected by the Department in the course of an examination or investigation of a licensee or applicant. Makes changes to provisions concerning legislative intent; definitions; the definition of the practice of funeral directing; the definition of the practice of funeral directing and embalming; license requirements for funeral directing; funeral director license and display; renewal, reinstatement, and restoration of a license; the disposition of unclaimed cremated remains; license requirements for funeral directing and embalming; applications; issuance and display of a license; the Funeral Directors and Embalmers Licensing and Disciplinary Board; and violations, grounds for discipline, penalties. Repeals provisions concerning reciprocity; the deposit of fees and fines; and rules. Also amends the Cemetery Oversight Act. Provides that certain moneys from the Cemetery Oversight Licensing and Disciplinary Fund shall be transferred (instead of deposited) into the Cemetery Relief Fund. Amends the Regulatory Sunset Act to extend the Funeral Directors and Embalmers Licensing Code from January 1, 2013 to January 1, 2023. Effective immediately.
