Synopsis As Introduced
Amends the Property Tax Code. Allows the chief county assessment officer to record a tax lien against property that was granted one or more erroneous homestead exemptions. Contains provisions concerning notice, hearings, and penalties.

House Committee Amendment No. 2
Replaces everything after the enacting clause. Reinserts the provisions of the introduced bill with changes. Provides that notice of intent to record a tax lien must be served both by regular mail and certified mail, return receipt requested. Provides that both the person to whom the most recent tax bill was mailed and the owner of record must be given notice. Provides that, at a hearing, certified title to the property that is issued by a title company licensed to do business in the State (instead of the county clerk or county recorder of deeds) and is free and clear of any liens imposed as a result of the granting of an erroneous homestead exemption, shall be prima facie evidence that the property owner is without notice of the erroneous homestead exemption. Provides that payment of the outstanding liability created by an erroneous homestead exemption shall be made to the chief county assessment officer who shall, upon receipt of the full amount due, provide in reasonable form a release of the lien and shall transmit the funds received to the county treasurer for distribution.

Replaces everything after the enacting clause. Amends the Illinois Municipal Code and the Counties Code. Provides that home rule municipalities with a population of more than 2,000,000 and home rule counties are not prohibited from imposing a tax on the use of a parking lot, garage, or other parking facility for consideration. Effective immediately or on the effective date of House Bill 5547 of the 97th General Assembly, whichever is later.
