Synopsis As Introduced
Amends the Ambulatory Surgical Treatment Center Act. Provides that notwithstanding any other statute, rule, or regulation to the contrary, beginning on January 1, 2015, an ambulatory surgical treatment center where abortions are performed, and any other facility where 50 or more abortions are performed in any calendar year, must comply with all of the statutes, rules, and regulations applicable to ambulatory surgical treatment centers generally. Provides that if any such ambulatory surgical treatment center commences any construction or major alteration on or after the effective date of the amendatory Act but before January 1, 2015, then the requirements prescribed by the amendatory Act shall apply.

Replaces the bill title to add that the bill may be referred to as the Women's Health and Safety Act of 2012. Replaces everything after the enacting clause with provisions similar to those of the bill. Amends the Ambulatory Surgical Treatment Center Act. Provides that "ambulatory surgical treatment center" includes a facility in which a surgical procedure (instead of a medical or surgical procedure) is used to terminate 50 or more pregnancies in any calendar year (instead of to terminate a pregnancy). Provides that an ambulatory surgical treatment center utilized to terminate pregnancies must comply with all of the statutes, rules, and regulations generally applicable to other ambulatory surgical treatment centers (eliminates a January 1, 2015 beginning date). Provides that an ambulatory surgical treatment center required to perform construction or other physical renovation in order to comply with the statutes, rules, and regulations applicable pursuant to these amendatory provisions shall have until January 1, 2016 to complete any such construction or other physical renovation.

 The cost to the Department of Public Health to implement HB 4117 is mostly unknown due to the fact that the number of facilities DPH would need to inspect is uncertain. The cost of a full ASTC survey is approximately $3500 each. Assuming there are 7 Pregnancy Termination Centers (PTC) and approximately 300 physician offices or clinics that perform 50 or more medical or surgical abortions the cost would be $1,074,500.

 HB 4117 (H-AM 1) modifies the original legislative proposal by clarifying that this legislation only addresses facilities that perform 50 or more surgical abortions (removed medical abortions). Assuming there are 7 Pregnancy Termination Centers (PTC) and approximately 50 physician offices or clinics that perform 50 surgical abortions, the cost would be $199,500.
