Synopsis As Introduced
Amends the Environmental Protection Act. Provides that it is not a violation of the Act to store or dispose of coal combustion waste that is reused as structural fill at a site or facility, if that waste is fully encapsulated. Defines "fully encapsulated" and "structural fill".

415 ILCS 5/3.135was 415 ILCS 5/3.94

Replaces everything after the enacting clause. Amends the Environmental Protection Act. Requires coal combustion waste, if used as structural fill in certain applications, to meet the ASTM standard for the design and construction of coal ash structural fills in order to qualify as coal combustion by-product. Effective immediately.

Senate Committee Amendment No. 1
Authorizes coal combustion waste to qualify as coal combustion by-product if, when used as structural fill, either the ASTM E2277-03 or Illinois Department of Transportation specifications are met.
