Synopsis As Introduced
Amends the Department of Human Services Act. Requires the Department of Human Services to promulgate rules by December 31, 2012 to ensure that infant formula packaged in containers made with the chemical bisphenol A (BPA) shall not be provided to women through the Women, Infants, and Children Nutrition Program.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Department of Human Services Act. Provides that on February 2, 2013, the Department of Human Services shall ensure that the infant formula provided to participants under the Women, Infants, and Children Nutrition Program is packaged in containers which do not contain the chemical bisphenol A (BPA). Provides that the Department may suspend implementation of this provision until the Department enters a new contract period equaling 5 years for any type of infant formula provided by the Program, if the following occur: (1) the Department determines that implementing the provision would decrease the availability of infant formula to participants of the Program or cause an unacceptable fiscal impact to the State; and (2) the Department publishes a notice of suspension in the Illinois Register.
