Synopsis As Introduced
Amends the Unified Code of Corrections. Provides that a period of probation, a term of periodic imprisonment, or conditional discharge shall not be imposed for conviction for aggravated assault if a firearm is used in the commission of the assault of a peace officer, a community policing volunteer, a private security officer, fireman, an emergency medical technician-ambulance, emergency medical technician-intermediate, emergency medical technician-paramedic, ambulance driver, or other medical assistance or first aid personnel while such person is engaged in the execution of any of his or her official duties, or to prevent such person from performing his or her official duties, or in retaliation for the person performing his or her official duties. Effective immediately.

Senate Committee Amendment No. 1
Replaces the substance of the bill. Amends the Unified Code of Corrections. Provides that a period of probation, a term of periodic imprisonment, or conditional discharge shall not be imposed for aggravated assault committed by a person who, in committing an assault, uses a firearm, if the firearm is aimed toward the person against whom the firearm is being used, other than by discharging the firearm, against a peace officer, community policing volunteer, fireman, private security officer, emergency management worker, emergency medical technician, employee of a police department, employee of a sheriff's department, or traffic control municipal employee: (1) performing his or her official duties; (2) assaulted to prevent performance of his or her official duties; or (3) assaulted in retaliation for performing his or her official duties. Effective July 1, 2011.
