Synopsis As Introduced
Amends the Environmental Protection Act. Authorizes owners and operators of clean construction and demolition debris soil fill operations, as well as the owners and operators of uncontaminated soil fill operations, to meet a certification requirement by, among other things, certifying that the soil was removed from a public highway right-of-way and is presumed to be uncontaminated soil. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Environmental Protection Act. Provides that the following items should be considered when determining whether soil within a transportation right of way or a utility easement has been used for commercial or industrial purposes: the current use of the property as a right of way or easement, the uses of the property prior to its use as a right of way or easement, and the uses of adjoining property. Effective immediately.

Replaces everything after the enacting clause. Amends the Environmental Protection Act. Authorizes the Illinois Pollution Control Board under certain circumstances to allow concentrations of the specified carcinogenic Polynuclear Aromatic Hydrocarbons (PAHs) (rather than just the carcinogen benzo(a)pyrene) to be present in soil used as fill material in a current or former quarry, mine, or other excavation, even if the presence of those chemicals in those locations poses an upper-bound lifetime cancer risk of greater than 1 in 1,000,000. Authorizes licensed Professional Geologists, as well as licensed Professional Engineers, to certify whether soil is uncontaminated soil. Effective immediately.
