Synopsis As Introduced
Amends the Innkeepers Lien Act. Provides that stable keepers shall have a lien for the cost of unpaid boarding and related expenses for a horse that is enforceable through the sale of the horse by public or private sale pursuant to provisions concerning notice, sale procedure, certificate of purchase, and application of sale proceeds.

House Floor Amendment No. 2
Replaces everything after the enacting clause with similar provisions that amend the Innkeepers Lien Act, except that the added provisions state that personal property stored at the stable or boarding facility is included in the lien and that a public sale can also be conducted by an authorized person other than the sheriff. Makes other changes.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause with provisions similar to the engrossed bill except that it: defines "personal property left on the premises"; provides that the enforcement of an innkeeper's lien includes the sale of any horse that is boarded along with any personal property left on the premises; provides that the keeper shall serve a written demand for payment on the horse owner 30 days prior to a public sale or private sale; provides that there shall be a public sale unless the boarding agreement provides authorization for a private sale or for the keeper to take ownership of the horse and any personal property left on the premises (instead of provides authorization for a private sale), provided that if the keeper seeks to obtain the horse, the demand for payment shall include an appraisal of the value of the horse and the personal property. Makes other changes.
