Synopsis As Introduced
Amends the Cannabis Control Act, the Illinois Controlled Substances Act, and the Methamphetamine Control and Community Protection Act. Provides that a person convicted of or placed on supervision for manufacturing or delivering cannabis, a controlled substance, or methamphetamine whose violation proximately caused any incident resulting in an appropriate emergency response shall be liable for the expense of the emergency response. Provides for additional assessments for persons convicted of any such offenses. Provides for the distribution of the additional assessments to various units of government. Provides that any moneys received by a law enforcement agency under these provisions shall be used to purchase law enforcement equipment that will assist in the prevention of drug related criminal violence throughout the State.

Replaces everything after the enacting clause. Reinserts the provisions of the bill. Amends the Clerks of Courts Act. Provides that of the amounts collected as fines under the Cannabis Control Act, the Illinois Controlled Substances Act, or the Methamphetamine Control and Community Protection Act for emergency response, 99% shall be deposited to the law enforcement agency or fund specified and 1% shall be deposited into the Circuit Court Clerk Operation and Administrative Fund to be used to offset the costs incurred by the Circuit Court Clerk in performing the additional duties required to collect and disburse funds to entities of State and local government as provided by law. Amends the Cannabis Control Act, the Illinois Controlled Substances Act, and the Methamphetamine Control and Community Protection Act. Changes the assessment fees to cover emergency responses.

Deletes reference to:
720 ILCS 550/10.4 new

Replaces everything after the enacting clause. Reinserts the provisions of the bill as amended but: (1) eliminates the amendatory changes to Cannabis Control Act; (2) changes the definition of "emergency response"; (3) makes conforming changes; (4) provides that the reimbursement fine applies to an offender whose violation proximately caused any incident resulting in an appropriate emergency response; and (5) changes references from "found guilty of" or "pleads guilty to" to "convicted of".
