Synopsis As Introduced
Amends the Landlord and Tenant Act. Provides that after a residential dwelling unit has been vacated by a tenant, a landlord must change the locks of the dwelling unit before it is again occupied and must provide a new tenant with a signed disclosure form acknowledging that this requirement has been met. Provides that if a landlord has not changed the locks, as required, and a theft occurs that is attributable to the landlord's failure to meet that requirement, the landlord is liable for any damages that the tenant incurs as a result of that failure.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Landlord and Tenant Act. Provides that a lessor of a dwelling unit shall change or rekey the immediate access to the dwelling unit every time a unit has been vacated. Provides that the failure of a lessor to change or rekey the access as required renders the lessor liable for damage due to theft attributable to not changing or rekeying the access. Effective January 1, 2012.

House Floor Amendment No. 2
Further amends the Landlord Tenant Act. Provides that these provisions do not apply to an apartment rental in an apartment building with 4 units or less when one of the units is occupied by the owner or to the rental of a room in a private home that is owner-occupied.

Senate Floor Amendment No. 1
Further amends the Landlord and Tenant Act. Provides that the changes concerning changing or rekeying a dwelling unit lock only apply in counties having a population of more than 3,000,000.
