Synopsis As Introduced
Amends the State Fire Marshal Act. Provides that the Office of the State Fire Marshal shall adopt a rule requiring, by January 1, 2012, each business that sells a tank containing liquid or compressed oxygen to an individual for residential oxygen therapy at an address in the State to register that address with the fire department or fire protection district that provides fire protection service for that address. Effective immediately.

Replaces everything after the enacting clause. Amends the State Comptroller Act. Provides that if a person is entitled to a warrant or payment from the State treasury and if a unit of local government, school district, or public institution of higher education holds a then due and payable account or claim against that person, then the State Comptroller may deduct, on behalf of that entity, the owed amount from the warrant or payment. Authorizes the Comptroller to collect a processing charge for these deductions. Requires all deducted amounts and processing charges to be deposited into the Comptroller Debt Recovery Trust Fund, a special fund that the Comptroller shall use for the collection of deductions and processing charges and the payment of deductions and administrative expenses. Establishes a procedure for protesting these deductions. Authorizes the Comptroller to enter into intergovernmental agreements pertaining to the administration of the offset system. Amends the Illinois Income Tax Act. Provides that the Department of Revenue shall honor refund withholding requests to collect debt owed to a unit of local government, school district, or public institution of higher education collected under an intergovernmental agreement in a particular order relative to other refund withholding requests. Provides that the effective date of Public Act 97-269 is the effective date of the amendatory Act or January 1, 2012, whichever is earlier (rather than January 1, 2012). Effective immediately.
