Synopsis As Introduced
Amends the State Fire Marshal Act. Provides that the Office of the State Fire Marshal shall adopt rules that, beginning July 1, 2012, prohibit the use of a rebuilt flame safeguard control in forced air heating equipment. Defines flame safeguard control.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Removes a provision in the introduced bill that requires the Office of the State Fire Marshal to adopt the rules concerning rebuilt flame safeguard controls, and instead makes the use of the controls in forced air heating equipment "in any non-residential structure" prohibited beginning July 1, 2012. Further amends the State Fire Marshal Act. Sets forth the penalties for violations of rebuilt flame safeguard control prohibitions.

Senate Committee Amendment No. 1
Further amends the State Fire Marshal Act. Provides that the prohibition on the use of rebuilt flame safeguard controls in forced air heating equipment in non-residential structures does not apply to structures used for production agriculture, as defined in the Use Tax Act.

Senate Floor Amendment No. 2
Reinserts the provisions of the engrossed bill and Senate Amendment 1. Further amends the State Fire Marshal Act. Provides that a rebuilt flame safeguard control is not prohibited from use in a non-residential structure if that control is "labeled and listed by a nationally recognized testing agency".
