Synopsis As Introduced
Creates the Public-Private Partnerships for Transportation Act. Contains a statement of public policy and legislative intent. Grants to the Illinois Department of Transportation and the Illinois State Toll Highway Authority the necessary powers for the development, financing, and operation of transportation projects through public-private agreements with one or more private entities. Contains provisions regarding procurement, agreements, development and operations standards for transportation projects, financial arrangements, acquisition of property, labor matters, law enforcement, property, powers, prohibitions, and other matters. Amends the Department of Transportation Law of the Civil Administrative Code of Illinois; Illinois Finance Authority Act; Illinois Procurement Code; Public Construction Bond Act; Employment of Illinois Workers on Public Works Act; Business Enterprise for Minorities, Females, and Persons with Disabilities Act; Retailers' Occupation Tax Act; Property Tax Code; Toll Highway Act; and Prevailing Wage Act to implement and conform to the new Act. Makes other changes. Effective immediately.

House Floor Amendment No. 1
Provides that the Authority shall not use any revenue generated by any toll highway, or portions thereof, under the Authority's jurisdiction which were open to vehicular traffic on the effective date of the Act to enter into or provide funding for a public-private agreement. Provides that the Authority shall not use any asset, or the proceeds from the sale or lease of any such asset, which was owned by the Authority on the effective date of the Act to enter into or provide funding for a public-private agreement.

Senate Floor Amendment No. 3
Deletes reference to:
35 ILCS 200/15-195 new

Removes an airport authority from the definition of transportation agency. Removes an airport owned and operated by an airport authority from the definition of transportation facility. Removes a taxation exemption for qualified airport leased property. Provides that the Toll Highway Authority may operate or provide operational services such as toll collection on highways which are developed or financed, or both, through a public-private agreement entered into by another public entity. Provides that to implement the powers conferred by the Act, the transportation agency may establish rules and procedures for the procurement of a public-private agreement under the Act. Provides that nothing contained in the Act is intended to supersede applicable federal law or to foreclose the use or potential use of federal funds. Provides that in the event any provision of the Act is inconsistent with applicable federal law or would have the effect of foreclosing the use or potential use of federal funds, the applicable federal law or funding condition shall prevail, but only to the extent of such inconsistency.
