Synopsis As Introduced
Amends the Liquor Control Act of 1934. Makes a technical change in a Section concerning retail sales on Sundays.

House Floor Amendment No. 1
Deletes reference to:
235 ILCS 5/6-14from Ch. 43, par. 129
Adds reference to:
235 ILCS 5/4-2from Ch. 43, par. 111
235 ILCS 5/6-2from Ch. 43, par. 120

Replaces everything after the enacting clause. Amends the Liquor Control Act of 1934. Provides that specified officials shall be the local liquor control commissioner for their respective territories as long as that official or his or her designee does not have a direct interest in the manufacture, sale, or distribution of alcoholic liquor. Provides that if the official has a direct interest in the manufacture, sale, or distribution of alcoholic liquor, the council or board over which he or she presides must appoint a liquor control commissioner other than that official. Provides that a mayor of a city, president of a village board of trustees, or chairman or president of a county board may have a direct interest in the manufacture, sale, or distribution of alcoholic liquor as long as the council or board appoints a liquor control commissioner pursuant to the provisions concerning specified officials as local liquor control commissioners. Effective immediately.

House Floor Amendment No. 2
Deletes the effective date provision.

Senate Floor Amendment No. 1
Replaces everything after the enacting clause with language that is similar to the engrossed bill except for the following changes. Provides that the mayor of a city with a population of 50,000 or less or the president of a village with a population of 50,000 or less who has an interest in the manufacture, sale, or distribution of alcoholic liquor must direct the council or board over which he or she presides to appoint, by majority vote, a person other than him or her to serve as the local liquor control commissioner. Provides for the timing of the appointment and the appointment procedures to be followed. Provides that the appointee (i) shall be an attorney licensed in Illinois, (ii) shall not legally represent liquor license applicants or holders before him or her or before an adjacent jurisdiction, (iii) shall not have an interest in the manufacture, sale, or distribution of alcoholic liquor, and (iv) shall not be appointed to a term to exceed the term of the mayor, president, or members of the council or board. Makes other changes. Effective immediately.
