HOUSE RESOLUTION

 
2     WHEREAS, In June of 2009, the Governor issued Executive
3 Order 15, which allows collective bargaining by individual
4 providers of home-based support services; and
 
5     WHEREAS, The Home-Based Services Program provides services
6 to individuals with severe disabilities who need help with
7 daily living activities in order to remain in their communities
8 and live as independently as possible; and
 
9     WHEREAS, Many of the individual providers of home-based
10 support services are parents who are providing services to
11 their children; and
 
12     WHEREAS, Continuity of care is important for profoundly
13 disabled children who are served in the program; even a minor
14 change in the care provided can have a significant negative
15 impact on the disabled child; and
 
16     WHEREAS, The payments given to parents who provide services
17 to their disabled children do not meet the cost of providing
18 care; and
 
19     WHEREAS, The unionization of providers of home-based
20 support services would decrease the resources that are

1 available to parents to provide necessary care to their
2 disabled children and could lead to the separation of disabled
3 children from their families and the placement of those
4 children in higher-cost State facilities; and
 
5     WHEREAS, Collective bargaining is allowed under many State
6 and federal laws, and many members of the Illinois House of
7 Representatives are strong supporters of America's tradition
8 of collective labor bargaining; and
 
9     WHEREAS, Executive Order 15 does not have a regulatory
10 sunset date, and it could allow for repeat and continuous
11 elections; and
 
12     WHEREAS, On October 19, 2009, individual providers of
13 home-based support services voted against collective
14 bargaining representation with an overwhelming 66% of the vote;
15 and
 
16     WHEREAS, Neither of the two unions seeking collective
17 bargaining status received more than 20% of the vote; and
 
18     WHEREAS, It is time to listen to the will of the individual
19 providers of home-based support services; therefore, be it
 
20     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE

1 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we
2 urge the Governor to reconsider Executive Order 15; and be it
3 further
 
4     RESOLVED, That we express our opinion that an objective
5 reconsideration of Executive Order 15 would lead to the
6 withdrawal of the gubernatorial order, as it does not reflect
7 the attitudes and desires of the individual providers of
8 home-based support services that the order sought to help; and
9 be it further
 
10     RESOLVED, That a suitable copy of this resolution be
11 presented to the Governor of the State of Illinois.
