| AMENDMENT NO. ______. Amend House Bill 2429 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Mercury-added Product Prohibition Act is |
5 |
| amended by adding Section 40 as follows: |

| (410 ILCS 46/40 new) |
7 |
| Sec. 40. Mercury-containing compact fluorescent lighting;
|
8 |
| Internet Web site and outreach; procurement. |
9 |
| (a) By October 1, 2009, the Agency shall create a Web site |
10 |
| that provides information on the mercury content of compact |
11 |
| fluorescent lamps used in residential applications, what to do |
12 |
| when a fluorescent lamp breaks, and options for consumers to |
13 |
| safely manage and recycle spent mercury-containing compact |
14 |
| fluorescent lamps generated in the State. The Agency shall also |
15 |
| collaborate with lamp manufacturers, retailers, utilities, |
16 |
| local governments, environmental organizations, and solid |

| waste haulers on outreach efforts to inform consumers about the |
2 |
| safe and proper management of spent mercury-containing |
3 |
| fluorescent lamps. In developing an outreach strategy, the |
4 |
| Agency shall consider a variety of media and methods for |
5 |
| disseminating information, including, but not limited to, |
6 |
| point of sale information, newspaper and magazine |
7 |
| advertisements, Web sites, package markings, bill inserts, |
8 |
| public service announcements, and stickers for dumpsters and |
9 |
| trash bins. |

| (b) By March 1, 2010, the Department of Central Management |
11 |
| Services, in collaboration with the Department of Commerce and |
12 |
| Economic Opportunity and the Agency, shall review and revise |
13 |
| procurement specifications for lamps and ballasts purchased by |
14 |
| State agencies. The specifications shall be revised to optimize |
15 |
| energy efficiency, toxics reduction, lighting quality, and |
16 |
| lamp life, taking into account performance, availability and |
17 |
| cost considerations. After July 1, 2010, the Department of |
18 |
| Central Management Services shall ensure that the |
19 |
| environmental and performance specifications developed under |
20 |
| this subsection are incorporated into bid solicitations |
21 |
| issued, and contracts entered into, for lamps and ballasts |
22 |
| purchased by State agencies. |
23 |
| (c) For the purposes of this subsection, |
24 |
| (1) "Lamp" means the bulb or tube portion of an |
25 |
| electrical lighting device, including, but not limited to, |
26 |
| a compact fluorescent lamp; a linear, circular or u-bent |
