1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Pharmacy Practice Act is amended by changing
5 Section 10 as follows:
 
6     (225 ILCS 85/10)  (from Ch. 111, par. 4130)
7     (Section scheduled to be repealed on January 1, 2018)
8     Sec. 10. State Board of Pharmacy. There is created in the
9 the Department the State Board of Pharmacy. It shall consist of
10 9 members, 7 of whom shall be licensed pharmacists. Each of
11 those 7 members must be a licensed pharmacist in good standing
12 in this State, a graduate of an accredited college of pharmacy
13 or hold a Bachelor of Science degree in Pharmacy and have at
14 least 5 years' practical experience in the practice of pharmacy
15 subsequent to the date of his licensure as a licensed
16 pharmacist in the State of Illinois. There shall be 2 public
17 members, who shall be voting members, who shall not be licensed
18 pharmacists in this State or any other state.
19     Each member shall be appointed by the Governor.
20     Members shall be appointed to 5 year terms. The Governor
21 shall fill any vacancy for the remainder of the unexpired term.
22 Partial terms over 3 years in length shall be considered full
23 terms. A member may be reappointed for a successive term, but

1 no member shall serve more than 2 full terms in his or her
2 lifetime.
3     In making the appointment of members on the Board, the
4 Governor shall give due consideration to recommendations by the
5 members of the profession of pharmacy and by pharmacy
6 organizations therein. The Governor shall notify the pharmacy
7 organizations promptly of any vacancy of members on the Board
8 and in appointing members shall give consideration to
9 individuals engaged in all types and settings of pharmacy
10 practice.
11     The Governor may remove any member of the Board for
12 misconduct, incapacity or neglect of duty and he shall be the
13 sole judge of the sufficiency of the cause for removal.
14     Each member of the Board shall be reimbursed for such
15 actual and legitimate expenses as he may incur in going to and
16 from the place of meeting and remaining thereat during sessions
17 of the Board. In addition, each member of the Board may receive
18 a per diem payment in an amount determined from time to time by
19 the Director for attendance at meetings of the Board and
20 conducting other official business of the Board.
21     The Board shall hold quarterly meetings at such times and
22 places and upon notice as the Department may determine and as
23 its business may require. A majority of the Board members
24 currently appointed shall constitute a quorum. A vacancy in the
25 membership of the Board shall not impair the right of a quorum
26 to exercise all the rights and perform all the duties of the

1 Board.
2     The Board shall exercise the rights, powers and duties
3 which have been vested in the Board under this Act, and any
4 other duties conferred upon the Board by law.
