SYNOPSIS AS INTRODUCED:
 
70 ILCS 2605/11.5   from Ch. 42, par. 331.5

    Amends the Metropolitan Water Reclamation District Act. In a Section pertaining to the procurement of materials and supplies during an operating emergency, provides that certain sanitary district officials and employees may purchase without advertisement emergency related supplies and materials where the amount is not in excess of $50,000 (now, $25,000). Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Metropolitan Water Reclamation District Act
5 is amended by changing Section 11.5 as follows:
 
6     (70 ILCS 2605/11.5)  (from Ch. 42, par. 331.5)
7     Sec. 11.5. In the event of an emergency affecting the
8 public health or safety, so declared by action of the board of
9 trustees, which declaration shall describe the nature of the
10 injurious effect upon the public health or safety, contracts
11 may be let to the extent necessary to resolve such emergency
12 without public advertisement. The declaration shall fix the
13 date upon which such emergency shall terminate. The date may be
14 extended or abridged by the board of trustees as in its
15 judgment the circumstances require.
16     The executive director appointed in accordance with
17 Section 4 of this Act shall authorize in writing and certify to
18 the director of procurement and materials management those
19 officials or employees of the several departments of the
20 sanitary district who may purchase in the open market without
21 filing a requisition or estimate therefor, and without
22 advertisement, any supplies, materials, equipment or services,
23 for immediate delivery to meet bona fide operating emergencies

1 where the amount thereof is not in excess of $50,000 $25,000;
2 provided, that the director of procurement and materials
3 management shall be notified of such emergency. A full written
4 account of any such emergency together with a requisition for
5 the materials, supplies, equipment or services required
6 therefor shall be submitted immediately by the requisitioning
7 agent to the executive director and such report and requisition
8 shall be submitted to the director of procurement and materials
9 management and shall be open to public inspection for a period
10 of at least one year subsequent to the date of such emergency
11 purchase. The exercise of authority in respect to purchases for
12 such bona fide operating emergencies shall not be dependent
13 upon a declaration of emergency by the board of trustees under
14 the first paragraph of this Section.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
