Amends the School Code. Requires the State Board of Education to adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2009 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2010.
Effective immediately.

| AN ACT concerning education.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The School Code is amended by adding Section |
5 |
| 2-3.148 as follows: |

| (105 ILCS 5/2-3.148 new) |

| Sec. 2-3.148. Trans fats ban. |
8 |
| (a) In this Section, "trans fats" means fats that are |
9 |
| artificially created through a chemical process involving the |
10 |
| hydrogenation of oils. |
11 |
| (b) The State Board of Education shall adopt rules for the |
12 |
| elimination of vegetable oils containing trans fats in foods |
13 |
| served in public school cafeterias beginning on July 1, 2009 |
14 |
| and for the elimination of all foods containing trans fats from |
15 |
| public schools beginning on July 1, 2010, which ban shall |
16 |
| include without limitation all foods sold as part of the school |
17 |
| breakfast and lunch programs under the School Breakfast and |
18 |
| Lunch Program Act, foods sold in vending machines on school |
19 |
| grounds, and competitive foods sold during school hours.

| Section 99. Effective date. This Act takes effect upon |
21 |
| becoming law.
