| (110 ILCS 805/7-17) (from Ch. 122, par. 107-17)

| Sec. 7-17. Any member or officer of the board, any officer |
3 |
| of the
city or any other person holding any trust or employment |
4 |
| under the board
or city who wilfully violates any of the |
5 |
| provisions of Sections 7-8 7-6
through 7-16 shall be guilty of |
6 |
| a business offense and may be fined not
exceeding $10,000 and |
7 |
| forfeits his right to and shall be removed from
his office, |
8 |
| trust or employment. Any such member, officer or person is
|
9 |
| liable for the amount of any loss or damage suffered by the |
10 |
| board
resulting from his violation of any of those Sections, to |
11 |
| be recovered
by the board or by any taxpayer in the name and |
12 |
| for the benefit of the
board, in a civil action. Any taxpayer |
13 |
| bringing an action
under this Section must file a bond for all |
14 |
| costs, and is liable for all
costs taxed against the board in |
15 |
| that suit. This Section does not bar
any other remedy.

| Sec. 14.5. Fees. Fees to cover the cost of reviewing |

| applications for a certificate of approval to establish or |

| operate a post-secondary educational institution may be set by |
4 |
| the Board by rule. |

| Rulemaking authority to implement this amendatory Act of |
6 |
| the 95th General Assembly, if any, is conditioned on the rules |
7 |
| being adopted in accordance with all provisions of the Illinois |
8 |
| Administrative Procedure Act and all rules and procedures of |
9 |
| the Joint Committee on Administrative Rules; any purported rule |
10 |
| not so adopted, for whatever reason, is unauthorized. |

| Sec. 14.10. Private College Academic Quality Assurance |
13 |
| Fund. The Private College Academic Quality Assurance Fund is |
14 |
| created as a special fund in the State treasury. All fees |
15 |
| collected for the administration and enforcement of this Act |
16 |
| must be deposited into this Fund. All money in the Fund must be |
17 |
| used, subject to appropriation, by the Board to supplement |
18 |
| support for the administration and enforcement of this Act and |
19 |
| must not be used for any other purpose. |
20 |
| Rulemaking authority to implement this amendatory Act of |
21 |
| the 95th General Assembly, if any, is conditioned on the rules |
22 |
| being adopted in accordance with all provisions of the Illinois |
