    Amends the Illinois Occupational Therapy Practice Act. Provides for the issuance of a specialty occupational therapist license by the Department of Financial and Professional Regulation to a person who seeks to practice music therapy, as that term is defined by rule of the Department, and who meets certain other qualifications.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Occupational Therapy Practice Act
5 is amended by changing Sections 2 and 8 as follows:
 
6     (225 ILCS 75/2)  (from Ch. 111, par. 3702)
7     (Section scheduled to be repealed on January 1, 2014)
8     Sec. 2. Definitions. In this Act:
9     (1) "Department" means the Department of Professional
10 Regulation.
11     (2) "Director" means the Director of Professional
12 Regulation.
13     (3) "Board" means the Illinois Occupational Therapy
14 Licensure Board appointed by the Director.
15     (4) " Occupational therapist" means a person initially
16 registered and licensed to practice occupational therapy as
17 defined in this Act, and whose license is in good standing.
18 "Occupational therapist" includes a person who possesses a
19 current valid specialty occupational therapist license issued
20 under this Act.
21     (5) "Occupational therapy assistant" means a person
22 initially registered and licensed to assist in the practice of
23 occupational therapy under the supervision of a licensed

1 occupational therapist, and to implement the occupational
2 therapy treatment program as established by the licensed
3 occupational therapist. Such program may include training in
4 activities of daily living, the use of therapeutic activity
5 including task oriented activity to enhance functional
6 performance, and guidance in the selection and use of adaptive
7 equipment.
8     (6) "Occupational therapy" means the therapeutic use of
9 purposeful and meaningful occupations or goal-directed
10 activities to evaluate and provide interventions for
11 individuals and populations who have a disease or disorder, an
12 impairment, an activity limitation, or a participation
13 restriction that interferes with their ability to function
14 independently in their daily life roles and to promote health
15 and wellness. Occupational therapy intervention may include
16 any of the following:
17         (a) remediation or restoration of performance
18     abilities that are limited due to impairment in biological,
19     physiological, psychological, or neurological processes;
20         (b) adaptation of task, process, or the environment or
21     the teaching of compensatory techniques in order to enhance
22     performance;
23         (c) disability prevention methods and techniques that
24     facilitate the development or safe application of
25     performance skills; and
26         (d) health promotion strategies and practices that

1     enhance performance abilities.
2     The licensed occupational therapist or licensed
3 occupational therapy assistant may assume a variety of roles in
4 his or her career including, but not limited to, practitioner,
5 supervisor of professional students and volunteers,
6 researcher, scholar, consultant, administrator, faculty,
7 clinical instructor, and educator of consumers, peers, and
8 family.
9     (7) "Occupational therapy services" means services that
10 may be provided to individuals and populations including,
11 without limitation, the following:
12         (a) evaluating, developing, improving, sustaining, or
13     restoring skills in activities of daily living, work, or
14     productive activities, including instrumental living and
15     play and leisure activities;
16         (b) evaluating, developing, remediating, or restoring
17     sensorimotor, cognitive, or psychosocial components of
18     performance;
19         (c) designing, fabricating, applying, or training in
20     the use of assistive technology or temporary, orthoses and
21     training in the use of orthoses and prostheses;
22         (d) adapting environments and processes, including the
23     application of ergonomic principles, to enhance
24     performance and safety in daily life roles;
25         (e) for the occupational therapist or occupational
26     therapy assistant possessing advanced training, skill, and

1     competency as demonstrated through examinations that shall
2     be determined by the Department, applying physical agent
3     modalities as an adjunct to or in preparation for
4     engagement in occupations;
5         (f) evaluating and providing intervention in
6     collaboration with the client, family, caregiver, or
7     others;
8         (g) educating the client, family, caregiver, or others
9     in carrying out appropriate nonskilled interventions; and
10         (h) consulting with groups, programs, organizations,
11     or communities to provide population-based services; and .
12         (i) for the occupational therapist who possesses a
13     current valid specialty occupational therapy license,
14     engaging in the practice of music therapy, as that term is
15     defined by rule of the Department.
16     (8) "An aide in occupational therapy" means an individual
17 who provides supportive services to occupational therapists or
18 occupational therapy assistants but who is not certified by a
19 nationally recognized occupational therapy certifying or
20 licensing body.

25     Sec. 8. Qualifications; specialty license.

1     (a) A person shall be qualified for licensure as an
2 occupational therapist if that person:
3         (1) has applied in writing in form and substance to the
4     Department;
5         (2) (blank);
6         (3) has completed an occupational therapy program of at
7     least 4 years in length, leading to a baccalaureate degree,
8     or its equivalent, approved by the Department; and
9         (4) has successfully completed the examination
10     authorized by the Department within the past 5 years.
11     (b) The Department shall issue a specialty occupational
12 therapist license to a person who seeks to practice music
13 therapy, as that term is defined by rule of the Department, and
14 who:
15         (1) has applied in writing in form and substance to the
16     Department; and
17         (2) in lieu of the requirements set forth in items (3)
18     and (4) of subsection (a) of this Section, provides proof
19     to the Department of music therapy certification from an
20     approved certifying entity.
