| AMENDMENT NO. ______. Amend Senate Bill 2005 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Counties Code is amended by changing |
5 |
| Section 5-1092 as follows:
|

| (55 ILCS 5/5-1092) (from Ch. 34, par. 5-1092)
|

| Sec. 5-1092. Inoperable motor vehicles. A county board may
|
8 |
| declare by ordinance inoperable motor vehicles, whether on |
9 |
| public or
private property, to be a nuisance and authorize |
10 |
| fines to be levied for the
failure of any person to obey a |
11 |
| notice received from the county which
states that such person |
12 |
| is to dispose of any inoperable motor vehicles
under his |
13 |
| control, and may authorize a law enforcement agency, with
|
14 |
| applicable jurisdiction, to remove, after 7 days from the |
15 |
| issuance of the
county notice, any inoperable motor vehicle or |
16 |
| parts thereof. However,
nothing in this Section shall apply to |
|

| any motor vehicle that is kept
within a building when not in |
2 |
| use, to operable historic vehicles over 25
years of age, or to |
3 |
| a motor vehicle on the premises of a place of business
engaged |
4 |
| in the wrecking or junking of motor vehicles.
|

| As used in this Section, "inoperable motor vehicle" means |
6 |
| any motor
vehicle from which, for a period of at least 7 days |
7 |
| or any
longer period of time fixed by ordinance, the engine, |
8 |
| wheels
or other parts have been removed, or on which the |
9 |
| engine, wheels or other
parts have been altered, damaged or |
10 |
| otherwise so treated that the vehicle
is incapable of being |
11 |
| driven under its own motor power. "Inoperable motor
vehicle" |
12 |
| shall not include a motor vehicle which has been rendered
|
13 |
| temporarily incapable of being driven under its own motor power |
14 |
| in order to
perform ordinary service or repair operations. In a |
15 |
| non-home rule county with a population of more than 250,000, |
16 |
| "inoperable motor vehicle" also includes any motor vehicle that |
17 |
| does not have a current license plate or current license tags |
18 |
| attached to it if a current license plate or license tags are |
19 |
| required under the Illinois Vehicle Code.

| Section 99. Effective date. This Act takes effect upon |
