Amends the School Construction Law. Subject to appropriation, authorizes the Capital Development Board to make construction grants to school districts for overcrowding relief construction projects, to be paid out of moneys appropriated for that purpose from the School Infrastructure Fund. Contains provisions concerning rules of the Board, applicant requirements, the identification of schools with the greatest overcrowding, and the determination of grant eligibility and levels for grants. Effective July 1, 2007.

| AN ACT concerning education.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The School Construction Law is amended by adding |
5 |
| Section 5-110 as follows: |
6 |
| (105 ILCS 230/5-110 new) |
7 |
| Sec. 5-110. Overcrowding relief construction grants. |
8 |
| (a) Subject to appropriation, the Capital Development |
9 |
| Board is authorized to make construction grants to school |
10 |
| districts for overcrowding relief construction projects. These |
11 |
| grants shall be paid out of moneys appropriated for that |
12 |
| purpose from the School Infrastructure Fund. |
13 |
| (b) The Capital Development Board shall adopt rules to |
14 |
| implement this Section. The rules may specify the following: |
15 |
| (1) the manner of applying for grants; |
16 |
| (2) project eligibility requirements; |
17 |
| (3) restrictions on the use of grant moneys; |
18 |
| (4) the manner in which recipients must account for the |
19 |
| use of grant moneys; and |
20 |
| (5) any other provision that the Capital Development |
21 |
| Board deems necessary to prioritize applications. |

| (c) Each school district that applies for a grant under |
23 |
| this Section shall complete and submit with its grant |
